The Auction Company, a California Corporation (“TAC”) provides to bidders at theauctioncompany.net the opportunity to bid live and in real time or leave an absentee bid at theauctioncompany.net Online Bidding Section. TAC reserves the right, at it’s sole discretion, to add, delete or change some or all of the Online Bidding requirements at any time without notice.
The following are the Online Bidding Terms and Conditions that govern the use of Online Bidding and must be accepted, without modification, before you may access Online Bidding services. The Online Bidding Terms and Conditions, together with any additional terms and conditions specific to a particular auction as listed in the Terms and Conditions on TAC’s website or the Auction Brochure for that particular auction, constitute the entire agreement between you and TAC regarding the use of Online Bidding services with respect to that auction.
As used in these Online Bidding Terms and Conditions, “you” are an individual acting on your own behalf, or an agent of a person or entity that has authorized you to act on their behalf; “we” and “us” mean TAC. TAC reserves the right, in our sole discretion, to allow or deny access to Online Bidding services to any person. Upon acceptance of your application for access to Online Bidding services, you will receive a bidder number that will be valid for a particular auction (you will receive a new bidder number for each auction) that will identify you whenever you place bids using Online Bidding services (your “Online Bidding Internet Bidding Number”). You are responsible for all activities that occur using your Online Bidding Internet Bidding Number.
In addition to applying for access to Online Bidding services, you will be required to register separately for each TAC auction in which you wish to place bids via Online Bidding. Successful registration for one auction does not guarantee registration for any other auction. TAC reserves the right to refuse to register any person for any auction. A $1,000 refundable deposit is required ($5,000 for international buyers) to register to bid online.
All items to be sold in this auction will be offered by lot number. The bidder offering the highest bid accepted by the Auctioneer shall be the Buyer (“Buyer”) of that offered lot. No Buyer shall retract his/her bid. All bids must be submitted in US dollars. Buyer agrees to accept the lot with no guarantees or warranties, and immediately accepts title to and all risks or loss and theft of property at award of bid. ALL SALES ARE FINAL. A bid that was unsuccessful may be reinstated if a problem arises with a higher bid. Bidders placing winning Online Bids will be notified by email. You may not make a bid under a false name or as agent for a person who would himself be prohibited by these Online Bidding Terms and Conditions from placing a bid on a particular lot. TAC reserves the right to reject any bid which we deem to not have been made in good faith, or which is restricted or prohibited by law. The winning bidder for a particular lot (the “Buyer”) shall have purchased that lot at the accepted bid amount. A TWENTY FIVE PERCENT (25%) DEPOSIT MAY BE REQUIRED AT OR AFTER AWARD OF BID. BY AGREEING TO THESE TERMS OF SALE, BUYER IS AUTHORIZING AUCTIONEER TO CHARGE BUYER’S SUPPLIED CREDIT CARD FOR UP TO TWENTY-FIVE PERCENT (25%) OF BUYERS PURCHASED ITEMS AND/OR THE BIDDER APPROVED DEPOSIT, IF AUCTIONEER DEEMS NECESSARY.
NOTICE TO THE PUBLIC REGARDING VEHICLE PURCHASES:
THERE IS NO COOLING-OFF PERIOD UNLESS YOU OBTAIN A CONTRACT CANCELLATION OPTION. California Law does not provide for a “cooling-off” or other cancellation period for vehicle lease or purchase contracts. Therefore, you cannot later cancel such contract simply because you change your mind, decide the vehicle costs too much, or wish you acquired a different vehicle. After you sign a motor vehicle purchase or lease contract, it may be canceled with the agreement of the seller or lessor or for legal cause, such as fraud. However, California law does require a dealer to offer a 2-day contract cancellation option on used vehicles with a purchase price of less than $40,000, subject to certain statutory conditions. This contract cancellation option requirement does not apply to the sale of a recreational vehicle, a motorcycle, or an off-highway motor vehicle subject to identification under California law. See the vehicle contract cancellation option agreement for details.
If you would like information about our “Contract Cancellation Option” please contact us Prior to bidding.
NOTICE TO CALIFORNIA HEAVY TRUCK BUYERS:
MAKE SURE YOU ARE AWARE OF CARB TRUCK COMPLIANCE RULES that started in 2020, The new laws have RESTRICTIVE REGISTRATIONS. If you have any questions, please call the Auction Office.
“An on-road heavy-duty diesel or alternative-diesel vehicle operated in California may be subject to the California Air Resources Board Regulation to Reduce Particulate Matter and Criteria Pollutant Emissions from In-Use Heavy-Duty Diesel Vehicles. It, therefore, could be subject to exhaust retrofit or accelerated turnover requirements to reduce emissions of air pollutants.” For more information, please visit the California Air Resources Board website at http://www.arb.ca.gov/dieseltruck

GENERAL: Auctioneer at its sole discretion, at any time, without notice or liability to buyer, may withdraw or cancel the sale of any time. Auctioneer shall settle any dispute arising from any bidding at its sole discretion and Auctioneer may put the disputed Lot up again for sale. Auctioneer reserves the right to refuse any bid, which they consider to be an insignificant advance over the preceding bid. If for any reason Auctioneer is unable to make available or deliver any item or clear title to the item, or documentation required of the item, whether before or after delivery, Auctioneer’s sole liability, if any, shall be the return of monies paid in respect of such item upon return by Buyer. Auctioneer has 30 days from the date Buyer pays to produce such documents. Any such purchase shall be returned or surrendered upon demand by Auctioneer.
